Terms of Service

RodyTech, LLC ("RodyTech," "we," "us," or "our") provides pre-made AI agent solutions for small businesses, including but not limited to:

• AI Lead Generation Agent - Automated lead research, prospecting, and outreach
• AI Social Media Agent - Automated social media content creation, scheduling, and engagement
• AI Customer Service Agent - Automated customer inquiry handling, support tickets, and follow-ups

Our services are designed for small businesses, primarily in Iowa and the greater United States.

Hybrid Pricing Model

Our services operate on a hybrid pricing model consisting of:

• One-time setup fee: A one-time payment for the initial configuration, customization, and deployment of your AI agent. This fee is non-refundable after the 30-day guarantee period, except as described in our Money-Back Guarantee.
• Monthly service fee: A recurring monthly payment for ongoing AI agent operation, maintenance, monitoring, and support. Monthly fees are billed at the beginning of each billing cycle.

Payment Processing

All payments are processed securely through our payment processor. You agree to provide accurate and complete payment information. Prices are in US dollars unless otherwise stated.

Late Payments

If a monthly payment fails, we will attempt to process it again within 3 business days. If payment remains unsuccessful after 7 days, we may suspend your AI agent services until payment is received. Continued non-payment for 30 days may result in termination of services.

We offer a 30-day money-back guarantee on all new service engagements. See our Money-Back Guarantee page for complete terms and conditions. Key provisions include:

• 30-day period begins from the date your AI agent is deployed and operational
• Refund covers both the setup fee and any monthly fees paid during the guarantee period
• You must communicate dissatisfaction and allow us to attempt resolution before requesting a refund
• Refunds are processed within 10 business days

You may cancel your monthly service at any time. Upon cancellation:

• Your AI agent will remain active until the end of your current billing cycle
• No further monthly charges will be applied
• The one-time setup fee is non-refundable after the 30-day guarantee period
• You retain ownership of any data or content generated during your service period
• No cancellation fees apply

We aim to deploy your AI agent within 7 days of receiving your initial setup payment and required information. Deployment timelines may vary based on:

• Complexity of your specific configuration
• Timeliness of information you provide (business details, access credentials, etc.)
• Third-party service availability

We will keep you informed of progress throughout the deployment process. While we make every effort to meet the 7-day target, it is an estimate, not a guarantee.

By using our services, you agree not to:

• Use our AI agents for illegal activities, spam, or harassment
• Attempt to reverse-engineer, decompile, or copy our AI agent technology
• Misrepresent communications sent by AI agents as personal human-written messages where legally required to disclose
• Use the services to violate any applicable laws or regulations
• Share your account credentials or allow unauthorized access to your AI agent
• Use the services in a way that could damage, disable, or impair our infrastructure

We reserve the right to suspend or terminate services for violations of this acceptable use policy.

Our IP: The AI agent technology, software, algorithms, and proprietary systems are owned by RodyTech, LLC. You receive a license to use the configured AI agent during your active service period.

Your Content: You retain ownership of all your business data, content, and materials provided to us. Any content generated by the AI agent on your behalf (emails, social posts, responses) is owned by you.

To the fullest extent permitted by Iowa law:

• RodyTech's total liability shall not exceed the total amount you paid for services in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not responsible for results achieved or not achieved through the use of our AI agents, including but not limited to leads generated, sales closed, or revenue earned
• We are not liable for any third-party service outages or failures that affect AI agent performance

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the fitness for a particular purpose or merchantability.

You agree to indemnify and hold harmless RodyTech, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the services or violation of these terms.

These terms are governed by the laws of the State of Iowa, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Polk County, Iowa.

We may update these terms from time to time. We will notify active clients of material changes via email at least 30 days before they take effect. Continued use of our services after changes become effective constitutes acceptance of the revised terms.
